D.C. Act 24-92. District of Columbia Public Schools 2021-2022 Funding Stabilization Emergency Amendment Act of 2021.
AN ACT
To amend, on an emergency basis, the Uniform Per Student Funding Formula for Public Schools and Public Charter Schools Act of 1998 to require school-level funding for all District of Columbia Public Schools in School Year 2021-2022 to be equal to or greater than those provided in School Year 2020-2021.
BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this act may be cited as the "District of Columbia Public Schools 2021-2022 Funding Stabilization Emergency Amendment Act of 2021".
Sec. 2. Section 108a(a) of the Uniform Per Student Funding Formula for Public Schools and Public Charter Schools Act of 1998, effective February 22, 2014 (D.C. Law 20-87; D.C. Official Code § 38-2907.01(a)), is amended as follows:
(a) Paragraph (2) is amended by striking the phrase "; and" and inserting a semicolon in its place.
(b) Paragraph (3) is amended by striking the period and inserting the phrase "; and" in its place.
(c) A new paragraph (4) is added to read as follows:
"(4) Notwithstanding paragraphs (1) through (3) of this subsection, in School Year 2021-22, provide each school with not less than 100% of its prior year allocation of Formula funds as provided by the Fiscal Year 2021 budget adopted by the Council ("FY 2021 budget allocation"); provided, that a school may receive less than 100% of such funds if that school is eliminating one or more grade levels offered at the school. A school eliminating one or more grade levels may receive less than 100% of its FY 2021 budget allocation as long as it receives at least as much funding per remaining grade level as it received under its FY 2021 budget allocation.".
Sec. 3. Fiscal impact statement.
The Council adopts the fiscal impact statement of the Budget Director as the fiscal impact statement required by section 4a of the General Legislative Procedures Act of 1975, approved October 16, 2006 (120 Stat. 2038; D.C. Official Code § 1-301.47a).
Sec. 4. Effective date.
This act shall take effect following approval by the Mayor (or in the event of veto by the Mayor, action by the Council to override the veto), and shall remain in effect for no longer than 90 days, as provided for emergency acts of the Council of the District of Columbia in section
412(a) of the District of Columbia Home Rule Act, approved December 24, 1973 (87 Stat. 788; D.C. Official Code § 1-204.12(a)).
