D.C. Law 24-219. Department of Health Functions Clarification Temporary Amendment Act of 2022.

AN ACT

To amend, on a temporary basis, section 4917(a) of the Department of Health Functions Clarification Act of 2001 to exempt the tobacco bar and retail store located at 1120 9th Street, N.W., from the revenue requirements needed to obtain an exemption from the Department of Health from indoor smoking prohibitions.

BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this act may be cited as the "Department of Health Functions Clarification Temporary Amendment Act of 2022".

Sec. 2. Section 4917(a) of the Department of Health Functions Clarification Act of 2001, effective April 4, 2006 (D.C. Law 16-90; D.C. Official Code § 7-741.03(a)), is amended as follows:

(a) Paragraph (5) is amended by striking the phrase "; and" and inserting a semicolon in its place.

(b) Paragraph (6) is amended by striking the period and inserting a semi-colon in its place.

(c) A new paragraph (7) is added to read as follows:

"(7) The establishment occupying the ground level of 1120 9th Street, N.W.".

Sec. 3. Fiscal impact statement.

The Council adopts the fiscal impact statement of the Budget Director as the fiscal impact statement required by section 4a of the General Legislative Procedures Act of 1975, approved October 16, 2006 (120 Stat. 2038; D.C. Official Code§ l-301.47a).

Sec. 4. Effective date.

(a) This act shall take effect following approval by the Mayor (or in the event of veto by the Mayor, action by the Council to override the veto), a 30-day period of Congressional review as provided in section 602(c)(1) of the District of Columbia Home Rule Act, approved December 24, 1973 (87 Stat. 813; D.C. Official Code § 1-206.02(c)(1)), and publication in the District of Columbia Register.

(b) This act shall expire after 225 days of its having taken effect.

The bill was adopted on first and second readings on Sept. 20, 2022, and Oct. 4, 2022, respectively. After mayoral review, it was assigned Act No. 24-609 on Oct. 31, 2022, and transmitted to Congress for its review. D.C. Law 24-219 became effective Dec. 21, 2022.
